| What is an
“individual at risk”? |
| Any person who is 18
years of age or older who is either a developmentally disabled
person or has degenerative brain disorder, mental illness and who
is: |

Mentally incapable of providing for his
or her needs for food, shelter, clothing or |
|
personal or health care and is experiencing or at risk of
experiencing abuse; or |
|
•
Unable to report cruel maltreatment
without assistance. |

| What type of abuse do
you need to prove to obtain an individual at risk order? |

•
Abuse that results in bodily harm or
great bodily harm |
|
•
Intimidates, humiliates, threatens,
frightens, harasses or confines |
|
•
Forcibly administering medication |
|
•
First, second, third, or fourth degree
sexual assault |

| Who can petition for
the order? |
| The adult at risk,
social workers, law enforcement personnel, parents, adult
siblings, adult children, legal guardians of the adult at risk and
county protective service agencies. |
| These restraining
orders are designed to prevent a person from causing interference
with an investigation of the abuse of an individual at risk, or
the delivery of protective services to or a protective placement
of the adult at risk. |

| How long can the
restraining order be granted for? |
| The order can be
granted for up to 2 years. |
