Harassment Restraining Orders

In Wisconsin, domestic abuse restraining orders are ONLY available to an adult victim of abuse whose abuser is:
   • An adult family member
   • An adult household member
   • A current or former adult dating partner
   • An adult with whom you have a child in common
   • An adult caregiver
Or is a victim of stalking and/or harassment.

What is harassment?
The legal definition of harassment includes abuse, sexual assault, stalking, striking, shoving, kicking or otherwise subjecting another person to physical contact, attempting or threatening to abuse, sexually assault, stalking, or subject another to physical contact, a repeated course of conduct or series of acts which harass or intimidate another person and which serve no legitimate purpose.
 
Who May the Petitioner File an HRO (harassment order) Against?
An adult or a child who engages in harassment.
 
What Types of Abuse Must be in the Petition to Obtain a HRO?
   • Striking, shoving, kicking or subjecting another to physical contact or attempting or
         threatening to do the same.
   • Engaging in or repeatedly committing acts which harass or intimidate another person.
   • Child abuse.
   • Sexual assault.
   • Stalking
 
What is the Cost to File a Petition?
The cost to file a HRO is $152. If there is domestic abuse or stalking involved the fee is waived. If you qualify you may fill out a Waiver of Fees for the HRO

What Does the Court Need to Find to Grant the HRO?
That there are reasonable grounds to believe the respondent has engaged in harassment with the intent to harass or intimidate the petitioner.
 
For How Long Can the HRO be Granted?
